TERMS AND CONDITIONS OF SALE

These Terms and Conditions govern the sale of products by Lurano Outdoor Living (“Lurano”, “we”, “our”, or “us”) to customers (“you” or “your”).
By placing an order with Lurano, whether online, by telephone, email, quotation acceptance or in person, you agree to be bound by these Terms and Conditions.
1. ABOUT US

2. PRODUCTS
Lurano supplies a range of outdoor living products including but not limited to:
- Composite Decking
- Aluminium Decking
- Ceramic Decking
- Fibre Cement Decking
- Fencing and Gates
- Verandas
- Carports
- Glass Rooms
- Pergolas
- Outdoor Kitchens
- Outdoor Furniture
- Barbecues
- Bin Storage
- Accessories and associated products
3. QUOTATIONS
3.1 All quotations are valid for 30 days unless otherwise stated.
3.2 Quotations are subject to product availability.
3.3 Lurano reserves the right to amend quotations prior to order acceptance where supplier costs, manufacturing costs, transport costs or other factors outside our reasonable control increase.
3.4 An order shall not be deemed accepted until confirmed by Lurano in writing.
4. PRICING
4.1 All prices are shown in Pounds Sterling (£).
4.2 VAT will be charged at the prevailing rate where applicable.
4.3 Delivery charges may apply and will be detailed on quotations, invoices or order confirmations.
4.4 Whilst every effort is made to ensure pricing accuracy, Lurano reserves the right to correct any pricing errors before accepting an order.5. PAYMENT TERMS
Standard Products
5.1 Full payment is required prior to dispatch or collection of all standard products, including but not limited to:
- Decking
- Fencing
- Outdoor Furniture
- Outdoor Kitchens
- Barbecues
- Bin Storage
- Accessories
5.2 No goods will be released until cleared funds have been received.
Verandas, Carports and Glass Rooms
5.3 A £50 CAD design fee is payable before CAD drawings are produced.
5.4 The £50 CAD fee will be deducted from the final invoice if the customer proceeds with the purchase.
5.5 If the customer chooses not to proceed with the purchase, the CAD fee is non-refundable.
5.6 A 50% deposit is required before an order is submitted for manufacture.
5.7 The remaining 50% balance must be paid in full before goods are released for collection or dispatch.
5.8 Lurano reserves the right to suspend manufacture, delivery or collection until full payment has been received.
6. CAD DRAWINGS AND APPROVAL
6.1 CAD drawings are produced for customer review and approval purposes.6.2 Customers are responsible for carefully reviewing all dimensions, layouts, specifications and details shown on CAD drawings.
6.3 Once CAD drawings have been approved by the customer, Lurano accepts no responsibility for any errors, omissions or changes that were visible on the approved drawings.
6.4 CAD approval constitutes acceptance of the design for manufacture.
7. BESPOKE AND MADE-TO-ORDER PRODUCTS
7.1 The following products are considered bespoke or made-to-order:
- Verandas
- Carports
- Glass Rooms
- Bespoke powder-coated products
- Custom-sized products
- CAD-approved systems
- Any product manufactured specifically to customer requirements
7.2 Once CAD approval has been provided and/or manufacture has commenced, orders cannot be cancelled, amended, returned or refunded.
7.3 This clause does not affect any statutory rights that may apply under consumer legislation.
8. PRODUCT INFORMATION
8.1 Whilst every effort is made to ensure accuracy, product images, brochures, colour samples, website content and marketing materials are provided for illustration purposes only.
8.2 Colours may vary due to manufacturing processes, lighting conditions, screen settings and natural material characteristics.
8.3 Customers are encouraged to request product samples before purchasing where available.
8.4 Samples are intended as a guide only and slight variations in colour, texture and appearance may occur between samples and the final supplied product.8.5 Lurano reserves the right to amend product specifications where manufacturers make improvements or changes without prior notice.
8.6 Measurements and dimensions are approximate unless expressly stated otherwise.
9. DELIVERY
9.1 Delivery dates are estimates only and cannot be guaranteed.
9.2 Lurano shall not be liable for delays caused by manufacturers, carriers, weather conditions, material shortages or circumstances beyond our reasonable control.
9.3 Customers must ensure suitable access is available for delivery vehicles.
9.4 Failed deliveries caused by restricted access, customer absence or incorrect information may incur additional delivery charges.
9.5 Deliveries may be made by third-party carriers.
9.6 Customers must inspect goods upon delivery.
9.7 Any shortages, damage or discrepancies must be reported within 48 hours of delivery.
9.8 Failure to report issues within this period may result in claims being rejected.
10. COLLECTION OF GOODS
10.1 Where collection is agreed, goods must be collected within the timescale agreed by Lurano.
10.2 Risk passes to the customer upon collection.
10.3 Customers are responsible for ensuring suitable transportation and load security.11. RISK AND OWNERSHIP
11.1 Risk in the goods passes to the customer upon delivery or collection.
11.2 Ownership of goods remains with Lurano until full payment has been received.
11.3 Until ownership passes, Lurano reserves the right to recover goods where payment remains outstanding.
12. INSTALLATION
12.1 Unless expressly agreed otherwise in writing, Lurano operates as a supply-only business.
12.2 Customers are responsible for ensuring products are installed correctly and in accordance with manufacturer instructions, industry standards and applicable regulations.
12.3 Lurano accepts no liability for defects, damage or failures arising from incorrect installation.
12.4 Lurano accepts no responsibility for installation costs, remedial works or associated expenses resulting from incorrect installation.
12.5 Where Lurano recommends or introduces a third-party installer, contractor or surveyor, such recommendation is made in good faith and for convenience only.
12.6 Any agreement for installation, surveying, site preparation or related services shall be solely between the customer and the third-party provider.
12.7 Lurano accepts no responsibility or liability for workmanship, installation quality, survey accuracy, project delays, damage, losses, costs or disputes arising from services provided by third parties.
13. SITE SUITABILITY
13.1 Customers are responsible for ensuring that their site is suitable for the intended product.
13.2 Lurano shall not be liable for additional costs arising from:
- Unsuitable ground conditions
- Structural issues
- Drainage issues
- Access restrictions
- Installation constraints
- Planning requirements
- Building Regulation requirements
13.3 Customers are responsible for obtaining any permissions, approvals or consents required prior to purchase or installation.
14. RETURNS, CANCELLATIONS AND REFUNDS
Unwanted Goods
14.1 Lurano does not accept returns, exchanges or refunds for:
- Change of mind purchases
- Products ordered incorrectly by the customer
- Products no longer required by the customer
- Incorrect quantities ordered by the customer
- Products that have been opened, installed, altered, modified or used
14.2 Customers are responsible for ensuring products are suitable for their intended application before purchase.
Bespoke and Made-to-Order Products
14.3 Bespoke and made-to-order products cannot be cancelled, returned or refunded once CAD approval has been provided and/or manufacture has commenced.
14.4 The £50 CAD fee is non-refundable where the customer chooses not to proceed with a purchase.
Faulty, Damaged or Incorrect Goods
14.5 Customers must inspect all goods upon delivery.14.6 Any shortages, damages, defects or incorrectly supplied goods must be reported within 48 hours of delivery.
14.7 Where goods are confirmed to be faulty, damaged in transit or incorrectly supplied, Lurano will investigate the claim and, where appropriate, provide a repair, replacement or refund in accordance with applicable consumer legislation.
14.8 Lurano may request photographs, descriptions of the issue and any other reasonable evidence to support a claim.
14.9 Nothing within these Terms and Conditions affects a customer’s statutory rights under the Consumer Rights Act 2015 or any other applicable legislation.
15. WARRANTY CLAIMS
15.1 Product warranties vary depending on the product and manufacturer.
15.2 Warranty claims must be supported by proof of purchase and any information reasonably requested by Lurano.
15.3 Warranties do not cover:
- Incorrect installation
- Misuse
- Neglect
- Lack of maintenance
- Accidental damage
- Storm damage
- Fair wear and tear
- Alterations by third parties
16. LIMITATION OF LIABILITY
16.1 Nothing within these Terms excludes liability for death, personal injury, fraud or any liability
that cannot legally be excluded.
16.2 Subject to Clause 16.1, Lurano shall not be liable for:
- Indirect losses
- Consequential losses
- Loss of profit
- Loss of business
- Third-party costs
- Installation costs
- Delays caused by third parties
16.3 Lurano’s total liability shall not exceed the value of the goods supplied.
17. FORCE MAJEURE
Lurano shall not be liable for delays or failures arising from circumstances beyond its reasonable control, including but not limited to:
- Extreme weather
- Supplier delays
- Material shortages
- Transport disruption
- Industrial disputes
- Government restrictions
- Acts of God
18. PRIVACY AND DATA PROTECTION
Customer information will be processed in accordance with UK GDPR legislation and Lurano’s Privacy Policy.
Information will only be used for legitimate business purposes including quotations, orders, deliveries, customer support and legal compliance.
19. GOVERNING LAW
These Terms and Conditions shall be governed by the laws of England and Wales.
Any dispute arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
